Cloture Vote on FISA

It seems a shame that we are now in a situation where a vote to deny cloture will be necessary to prevent the Republicans from winning the battle to grant immunity to the telecom companies who aided in spying on American citizens in contravention of the existing FISA law passed in the aftermath of the Nixon presidency. This situation could have been avoided if the alternate, non immunity granting version of the bill had been allowed to reach the senate floor instead of the J. Rockefeller/intelligence committee version.

Was this a mistake? Or is it just another way to allow the immunity granting version of the bill to pass without taking responsibility for the outcome?
